People who have risen to the very top of their field of endeavor can qualify for this category which requires neither a labor certification nor a job offer. Persons who have received national or internationally recognized prizes and awards are good candidates for this category. Some examples of cases this office has handled include computer scientists, nuclear scientists, biologists, botanists, materials scientists, a foreign government expert in international money transactions, an internationally renown Clydesdale horseman, and athletes at the top of their sport.
Elly Appel, a several times women's singles champion of the Netherlands and winner of the Swedish Open achieved a world professional rank of 32 during her tenure on the Women's Tennis Association circuit. In 2000, she became the world champion on the senior circuit. Our office prepared a petition for extraordinary ability, and Ms. Appel was granted this prestigious status late last year. She continues to teach in Michigan and compete all over the world. Mari Morgan, an illustrative, interpretative Welsh language mezzo soprano, was granted extraordinary ability status in 1995 and is performing and leading groups around the United States. Other recent cases include a master martial arts instructor, who was crowned several times as a national champion in his home country, and who plans to bring to the U.S. a new form of martial arts.
Those who have such awards as Nobel Prizes, Grand Slam Championships, or Time Magazine's Scientist of the Year present very clear cases for extraordinary ability. Most cases are not quite as easy, but one can still qualify without such prizes. If you would like to know more about whether your case may be able to meet the standards for extraordinary ability, please contact us or fill out the form below and see "How can I find out if I have a good case?"
For information on what happens after you have obtained extraordinary ability status, please visit our section entitled "Consular Processing and Adjustment of Status."
