Aliens of Exceptional Ability: (EB-2: Employment-based second preference)

This category is similar to "aliens of extraordinary ability" except that the standards are slightly different. As suggested in the title, this preference category is lower than the extraordinary ability category, offering another option to those who may not yet qualify for extraordinary ability status. Person who might qualify for the exceptional ability category are those who have won significant national or international prizes, who have published extensively in their field, who have discovered a new or novel item or process (whether scientific or in the arts or business), or who have achieved a high level of national or international acclaim.

This category requires a labor certification and a job offer, unless a national interest waiver is obtained.

Our office has helped to obtain exceptional ability status for nuclear scientists, computer scientists, musicians, and athletes. If you would like additional information on the exceptional ability category, please contact our office and visit "How can I find out if I have a good case?"

For information on what happens after you have obtained exceptional ability status, please visit our section entitled "Consular Processing and Adjustment of Status."
